GENERAL TERMS AND CONDITIONS OF CARRIAGE

“EGO Airways”, means EGO Airways S.p.A., a company with registered office in 20135 Milan, Piazzale Libia 2, Tax Code and VAT nr 10927710961, website www.egoairways.com, IATA identification code “E3”.

 

1. DEFINITIONS

“BAGGAGE” means the personal belongings that the Passenger carries with him/her when travelling. Unless otherwise indicated, the term Baggage includes both Registered Baggage and Non-Registered Baggage.

“REGISTERED BAGGAGE” means Baggage given into custody to EGO Airways for carriage in the aircraft’s cargo hold and on which EGO Airways issues the Baggage Identification Tag.

“NON-REGISTERED BAGGAGE” means any other Passenger’s Baggage other than the Registered Baggage.

“TICKET” means the document issued by EGO Airways or, on its behalf, by authorised agents (also in electronic format), that confirms the conclusion of the contract of carriage and the legitimate use of the transportation services by the Passenger.

“BOARDING PASS” means the document issued to the Passenger after the online check-in or the document issued directly by EGO Airways or by one of its representatives, also in paper format, at the check-in desk of one of the airports served by the airline.

“ITALIAN CIVIL CODE” means the set of rules approved by Royal Decree n. 262 of 16.3.1942 and subsequent amendments.

“ITALIAN NAVIGATION CODE” means the set of rules approved by Royal Decree n. 327 of 30.3.1942 and subsequent amendments.

“AIRLINE DESIGNATOR CODE” means both the two-letter “E3” IATA code and the three-letter “EGW” ICAO code, which identify EGO Airways as the air Carrier.

“CONVENTION” means The Montreal Convention for the Unification of Certain Rules for International Carriage, signed in Montreal on May 28th, 1999.

“DAMAGES” mean death, wounding or bodily injuries suffered by a Passenger as a result of an accident occurring on an aircraft, during the boarding or disembarkation procedures, during the flight or during take-off or landing procedures; or the loss of Baggage, either total or partial, theft or damage thereof, occurring during the transportation on an EGO Airways flight or in connection with any services provided by the airline.          
“SDR” (Special Drawing Rights) means the Special Drawing Rights as defined by the International Monetary Fund (the current value of this currency unit is indicated on the financial pages of major newspapers).

“BAGGAGE IDENTIFICATION TAG" means the document issued by EGO Airways exclusively for the purpose of identifying the Registered Baggage.

“BAGGAGE ALLOWANCE” means the maximum weight that can be carried free of charge on EGO Airways’ scheduled flights with reference to the REGISTERED BAGGAGE, which may differ based on the fare purchased and the origin and destination of the flight. The Baggage Allowance is determined at the time of purchase and will be shown on the Ticket.

“DAYS” mean calendar days, including non-working days or holidays; in the case of notifications, the day on which the communication is sent will not be counted; for the purpose of determining the period of validity, the day on which the Ticket is issued or transportation begins will not be counted.

“IATA” means the International Air Transport Association, an organisation whose members account for the majority of commercial carriers worldwide that operate scheduled flights.

“PASSENGER” means any individual, who is not a member of the flight crew or cabin crew of the flight concerned, carried or to be carried on an aircraft with the approval of EGO Airways, whose name appears on the Ticket.

“EGO AIRWAYS WEBSITE” means the company’s website (www.egoairways.com) where these General Terms and Conditions of Carriage and any pages referred to in these General Terms and Conditions of Carriage are accessible.

“HOLD” means the part of the aircraft used for the storage of Registered Baggage.

“CHECK-IN TIME LIMIT” means the maximum time limit indicated by EGO Airways by which the Passenger must have obtained the Boarding Pass and, if applicable, carried out visa/identity card controls, paid the supplements due for Registered Baggage and delivered the Registered Baggage at the check-in desk (on the baggage belt). The same time limit applies in the event of online check-in insofar as the above mentioned activities and requirements apply to the Passenger.

“CARRIER” means the airline performing the air transport, which can be either the contractual carrier or the operating carrier. The former is the carrier that issues the Ticket, i.e. that is a party to the contract of carriage (concluded with the Passenger or a person on behalf of the Passenger), according to which the transportation of the Passenger and/or of its Baggage is carried. The latter is the operator, other than the contracting carrier, who, by means of an agreement with or an authorisation of the contracting carrier, performs all or part of the intended carriage.

 

2. APPLICABILITY, OVERRIDING LAW, APPLICABLE LAW AND JURISDICTION

2.1. GENERAL PROVISIONS

2.1.1. Without prejudice to article 2.1.4., these General Terms and Conditions of Carriage shall apply exclusively to flights, or flight segments, operated by EGO Airways and for which EGO Airways’ name or Airline Designator Code is indicated on the Ticket.

2.1.2. These General Terms and Conditions of Carriage also apply to free-of-charge or discounted tickets, except where otherwise indicated during the booking and purchase of the Ticket.

2.1.3.The provision of any ancillary services, including those offered through EGO Airways, is governed by the rules applicable to such services, as well as by the general terms and conditions of the relevant service provider.

2.1.4. EGO Airways shall apply the contractual terms and conditions that are customary in international air transport. If the flight is operated by a Carrier other than EGO Airways (so-called operating Carrier), the operating Carrier’s general conditions of carriage, which can be accessed on EGO Airways’ website as part of the purchase process or on the operating Carrier’s website, will also apply. In the event of any discrepancy between these General Terms and Conditions of Carriage and the operating Carrier’s general conditions of carriage, the latter will prevail. EGO Airways, as the contracting Carrier, including through its authorised agents, will inform the Passenger of the identity of the operating Carrier.

2.1.5. These General Terms and Conditions of Carriage cannot be amended, replaced or cancelled by any agent, officer, employee or representative of EGO Airways.

 

2.2.OVERRIDING LAW

2.2.1. These General Terms and Conditions of Carriage are applicable unless they are inconsistent with applicable law. In the event of conflict between these General Terms and Conditions of Carriage and the law applicable to the contract of carriage, the latter shall prevail.

2.2.2. If any provision of these General Terms and Conditions of Carriage is invalid under any applicable law, the rest of the terms will still remain valid to the extent that the invalid provision does not affect their validity.

 

2.3. GOVERNING LAW AND JURISDICTION

2.3.1. The contract of carriage between the Passenger and EGO Airways, as well as these General Terms and Conditions of Carriage will be governed by and interpreted in accordance with the laws of Italy, without prejudice to the application of international laws governing air transport.

2.3.2. The courts of law where the Passenger has his/her domicile shall have exclusive jurisdiction over the contract of carriage and on any dispute relating to the interpretation and application of these General Terms and Conditions of Carriage. The Passenger may, at his/her own choice, take legal action against EGO Airways before the competent courts of law according to the applicable international laws.

 

3.BOOKINGS AND DOCUMENTATION

3.1. GENERAL PROVISIONS

3.1.1. The Ticket constitutes proof of the contract of carriage between EGO Airways and the Passenger identified in the Ticket. EGO Airways will only carry the Passenger(s) named in the relevant Ticket. To this end, EGO Airways will request the Passenger(s) to prove his/her identity and, in any case, to comply with the rules applicable to documents.

3.1.2. The requirements (age, residence, etc. ) requested to benefit from special or dedicated fares may be verified by EGO Airways at any time and must be met at the time of boarding the flight. If any of these requirements is not met, the Passenger will be required to pay the difference between the fare already purchased and the fare available at the time of departure for the same flight class.

3.1.3. EGO Airways may refuse carriage if the Passenger’s identity documents are for any reason invalid, or are shown by a person other than the holder, or if the Passenger has obtained the Ticket in violation of the applicable fares, or the Ticket is presented by a person other than the holder.

3.1.4. EGO Airways will not be liable towards the person entitled to carriage or reimbursement if, in good faith, it provides the carriage or make the reimbursement to any person who, although showing the Ticket, is not its legitimate holder.

3.1.5. The Ticket purchase may be preceded by a booking. Bookings are not accepted until confirmed by EGO Airways or its authorised agents. In any case, the contract of carriage will not be deemed to have been concluded until the Ticket price has been paid. If the Passenger fails to pay the price of the Ticket before the expiry of the deadline for its issue, as specified by EGO Airways or its authorised agents at the time of booking, EGO Airways may cancel the booking. Any increase or decrease in fares, taxes and charges imposed by third parties (airport charges and other security-related fees, taxes or surcharges and the like) during the period between the booking confirmation and the payment of the Ticket price will be, respectively, for the account or in favor of the Passenger who decides to finalise the purchase of the Ticket.

3.1.6. A dedicated fee (Infant Fee) applies to infants who are under 24 months of age. Infants are not allowed, for safety reasons, to occupy a seat and must travel on an adult’s lap, except as provided in article 7 below. The fee is charged to infants who are under 24 months of age during the period between the date of departure and the date of return of the flight. The fee has to be paid per infant/per route. Except as provided for in article 12.1 below, the fee is not refundable.

 

3.2. NAME AND ADDRESS

3.2.1. The reference “EGO Airways S.p.A.” may be abbreviated to the Airline Designator Code (E3/EGW), or otherwise as shown In the Ticket. EGO Airways S.p.A. has its registered office in Piazzale Libia 2, 20135, Milan, Italy.

 

3.3. CONTACTS

3.3.1. In the event of flight changes and/or flights cancellations, or if other notices are necessary, EGO Airways will inform the Passenger by email, or text message, to the address or mobile number provided by the Passenger at the time of booking. Evidence of sending the email/text message will be considered proof of receipt. This is without prejudice to the provisions of article 11.1.2 below.

3.3.2. In case the Passenger has not provided EGO Airways with a valid e-mail address or telephone number, the Passenger must check the timetable for the outbound/return flight between 24 and 72 hours prior to the scheduled time of departure by accessing the booking page on the website https://www.egoairways.com

3.3.3. Any claim or request for compensation must be sent to EGO Airways through registered mail, fax, certified electronic email or by using the claim form available online at https://www.egoairways.com. Unless otherwise indicated, it is advised to send any document in copy, since the documents sent to EGO Airways will not be kept nor returned.

 

4. FARES

4.1. TAXES, FEES AND CHARGES

4.1.1. FARES

4.1.1. Unless otherwise expressly indicated, fares apply only to the transport from the airport of departure to the airport of destination. Fares are calculated in accordance with the fares applied by EGO Airways on the date of payment for travel on the date and itinerary specified in the Ticket. In the event the Passenger make changes to the itinerary or dates of travel, the amount payable may vary. If the fare for the new Ticket is higher than the fare originally paid, the Passenger will be required to pay the fare difference. If the fare of the new Ticket is lower than the price originally paid, the price difference will not be refunded.

 

4.2. TAXES, FEES AND CHARGES

4.2.1. At the time of booking, the Passenger must pay the airport charges, the government taxes and any additional fees charged for services relating to the flight operated by EGO Airways.

4.2.2. In case the Passenger decides not to travel, he/she may submit in writing to EGO Airways a request for reimbursement of the government taxes and/or the refundable component per Passenger relating to the paid airport charges. With the exception of such government taxes and airport charges, all other paid amounts are non-refundable. The refund is not due in case of promotional fares where the Passenger has not paid the government taxes or airport charges.

4.2.3. The price of the Ticket will be subject to VAT -Value Added Tax- to the extent applicable according to the route purchased by the Passenger.

 

4.3. CURRENCY

4.3.1. Fares, taxes, fees or charges shall be paid in the currency of the country of departure of the flight unless otherwise specified by EGO Airways- such as in the case of the local currency cannot be converted. EGO Airways may, at its discretion, accept the payment in a currency other than the currency of the country of departure.

4.3.2. EGO Airways guarantees the exchange rate for the payment at the time the Passenger books the Ticket. This exchange rate will not change. If Passenger does not accept EGO Airways’ currency exchange rate, there may be negative currency fluctuations between the time of booking confirmation and the time of payment by credit card, since in most cases the conversion rate is applied a number of days after the date the booking is made.

 

5. SPECIAL ASSISTANCE

5.1. Without prejudice to Article 5.2, EGO Airways will not deny carriage to Passengers with disabilities or reduced mobility on the basis of such disabilities or reduced mobility. The carriage of unaccompanied minors, disabled people, pregnant women, persons with illness, blind or visually impaired Passengers or other people requiring special assistance is subject to a specific prior agreement between EGO Airways and the Passenger in accordance with the provisions of Regulation (EC) No 1107/2006.

5.2. Passengers with disabilities or reduced mobility or their representatives should contact EGO Airways specifying the type of assistance required. This communication must take place on the day the booking is confirmed or as soon as possible when the Passenger becomes aware of the need for such assistance and, in any case, at least seventy-two (72) hours before the scheduled departure time. EGO Airways will endeavor to verify the existence of security risks that may prevent the accommodation of the Passenger(s) on the flight(s) concerned and, if necessary, to propose an acceptable alternative to the Passenger. In accordance with Regulation (EC) No 1107/2006, based on the degree of impairment or reduced mobility of the Passenger, EGO Airways may deny boarding to disabled people or persons with reduced mobility on the basis of the applicable safety requirements or in the event that the size of the plane or the exit doors make it physically impossible to board or carry the Passenger. Once the commitment has been made to provide any type of assistance and to satisfy any need, EGO Airways will arrange for boarding and provide in-flight assistance in accordance with Regulation (EC) No 1107/2006, EGO Airways will offer reimbursement or re-routing on an alternative flight in accordance with Regulation (EC) No. 261/2004, provided that all safety requirements are met, to Passengers with disabilities or reduced mobility who are denied boarding on the basis of their impairment or reduced mobility and to each person travelling with them. 6. SEATING AND CHECK-IN

6.1. All EGO Airways flights have allocated seating. EGO Airways reserves the right to assign or reassign seats on the aircraft at any time, even after boarding, if this is necessary for operational, security or safety reasons.

6.2. For Passengers who purchase a seat, online check-in is available from fifteen (15) days before the scheduled flight date up to two (2) hours before departure time. For Passengers who do not purchase a seat, online check-in is available from twenty-four (24) hours and up to two (2) hours before departure time and they will be assigned a seat free of charge. All Passengers, for all flights, both at the airport security checkpoint and at the boarding gate, must show a valid travel document bearing the same identification data appearing on the Boarding Pass. Any omission of names and/or surnames or typing errors may result in denied boarding by the airline without any right to a refund.

6.3. The time limit for check-in varies depending on the airport. Therefore, Passengers must comply with the time limits in force. In any case, EGO Airways or its authorised agents will provide Passengers with an indication of the time limit for check-in of the flight indicated on the Ticket. Passengers must complete the check-in operations, within the check-in time limit for boarding indicated by EGO Airways, in order to allow the completion of all administrative and boarding formalities. Passengers who arrive at the boarding gate after the time limit will not be boarded and their Ticket will not be refunded. In order to travel on a later flight, Passengers must complete and pay for a new booking.

6.4. Special indications or timings may be provided for special categories of Passengers, such as persons with reduced mobility, minors under the age of two (2) years, unaccompanied minors or those traveling with an animal. These timings will be communicated to the Passenger by email or text message to the e-mail address or telephone number provided at the time of booking by the Passenger or by the intermediary making the reservation on behalf of the Passenger.

6.5. It is not permitted to carry hot drinks or consume one’s own alcoholic beverages on board EGO Airways aircraft.

6.6. Smoking is prohibited on board EGO Airways aircraft. Violation of this prohibition will result in the payment of the penalties provided for by law, without prejudice to the right of EGO Airways to claim for damages. In accordance with the relevant IATA procedure, the prohibition of smoking on board aircraft is also extended to electronic cigarettes with effect from the 1st of April 2013.

6.7. EGO Airways will not be liable to Passengers for any damages, costs, or penalties resulting from their failure to comply with the preceding articles 6.1 to 6.6 above.

6.8. All Passengers who are not EU/EEA nationals must have their travel documents checked at the check-in desk in order to verify the existence of all formal requirements for entry into the country of destination before proceeding with the issuance of the Boarding Pass.

 

7. MINORS

7.1. Each minor under the age of two (2) years must be accompanied by at least one parent or an adult and their presence on board must be indicated during the booking process by purchasing a dedicated fare. The Infant Fee is provided for infants under the age of two (2) years who travel on an adult's lap. If the minor under the age of two (2) years uses his or her homologated car seat on board the aircraft, the parent/adult must purchase a seat for the child and pay the Child Fare. The Child Fare can be purchased in addition to the Infant Fee, also after the booking, at the cost of the fare difference; the Child Fee can be purchased by calling the call center or directly at the airport within the closing time of check-in at the authorised ticket offices. Passengers traveling with minors under the age of two (2) years who choose to purchase and select a seat, and who have been assigned seats not close to each other, are requested to contact EGO Airways so that assistance can be provided in this regard. Such Passengers may also contact EGO Airways for the same assistance when purchasing seats, in case adjacent seats are unavailable at the time of booking.

7.2. For domestic and international flights, minors between the age of five (5) and fifteen (15) who travel alone or in a different class than that of the parent(s) or guardian or accompanying adult, may be accepted on board EGO Airways flights, at the request of the parent(s), guardian or accompanying adult, according to the procedure available on EGO Airways’ website at the pages "Children under the age of 15" and "Unaccompanied minors", subject to payment of the applicable fee. An accompanying adult is defined as the person of legal age to whom the minor has been entrusted and as appearing from appropriate documentation.

7.3. For domestic and international flights, minors who have reached the age of fifteen (15) can travel alone and the procedure referred to in Article 7.2 above will not apply to them. The same rules and procedures applicable to all other Passengers will apply. However, upon express request and upon payment of the applicable fee, they may benefit from the procedure for unaccompanied minors as described above, thus falling within the scope of article 7.2 above. More information on the unaccompanied minor procedure and related fees can be found on EGO Airways’ website at the “Unaccompanied Minors” page or communicated by the ticket office operators or authorised agents. Furthermore, since the need for hotel accommodation may arise during the trip, both in the case of scheduled stops and in the event of flight delays or cancellations, minors must in any case be provided with the authorisation of a parent exercising parental authority which may be requested by hotels for their acceptance. EGO Airways shall not be liable for damages or expenses and for any further consequence resulting from the lack of possession of the aforementioned authorisation. In any case, the parents and/or the guardians shall be liable for damages caused by minors to third parties, to EGO Airways and to EGO Airways staff pursuant to article 2048 of the Italian Civil Code and shall be obliged to indemnify the airline.

8. PREGNANT PASSENGERS

8.1. EGO Airways accepts pregnant Passengers on board up to 34 weeks. For twin pregnancies, the time is reduced to 28 weeks. In the case of a single pregnancy, from the 28th to the 34th week, a “fit to fly” letter, completed by the attending physician, is always required. 9. REFUSAL OF CARRIAGE

9.1. EGO Airways reserves the right not to conclude a contract of carriage with a Passenger to whom it has previously notified in writing its refusal to conclude future contracts

9.2. EGO Airways may also refuse to carry the Passenger and his/her Baggage if one or more of the following circumstances occur, or if EGO Airways reasonably believes that one or more of the following may occur:

• the refusal is necessary to comply with the law or other binding provisions;

• the carriage of the Passenger or his/her Baggage may affect other Passengers or crew members, or affect their safety, health or tranquility;

• the Passenger’s mental or physical state, attitude or behavior, including any alteration due to the use of alcohol or drugs, presents a risk factor for the Passenger himself, for other Passengers, for the crew or for goods on board the aircraft;

• the Passenger has behaved in an unlawful or unacceptable way on a previous flight and EGO Airways has reason to believe that such behavior may be repeated;

• the Passenger has refused to go through security checks;

• the Passenger has not paid the price of the Ticket, taxes, airport charges or applicable fees;

• the Passenger owes EGO Airways a sum of money in relation to a previous flight as he/she has not completed, has refused to complete, or has re-credited the payment of such sum;

• the Passenger does not have valid travel documents required for entry into a transit country or the country of final destination, has destroyed the travel documents or refused to show the travel documents to the crew, upon request;

• the Passenger cannot prove to be the person named on the Boarding Pass;

• there is no correspondence between the name on the identity document used for identification and the name on the Ticket or on the Boarding Pass;

• the Passenger failed to comply with EGO Airways instructions on flight safety;

• the Passenger has smoked, or attempted to smoke, on a previous flight.

9.3. In the event that, in accordance with article 9.2, EGO Airways refuses to carry a Passenger on the basis of the above, or if it has removed the Passenger "en route", EGO Airways may cancel the unused part of the Ticket without any right of the Passenger to further benefit of the carriage or to claim a refund of the price paid. EGO Airways shall not be liable for any loss or alleged damage arising from any refusal of carriage that it may have imposed on the Passenger in accordance with this section.

 

10. BAGGAGE

10.1. EXCESS BAGGAGE AND CARRIAGE OF CERTAIN ITEMS

10.1.1. The maximum weight limit for Baggage that can be purchased online or through the call center is 30 kg in total per Passenger, regardless of the number of items.

10.1.2. The carriage of animals, sport equipment, musical instruments and other objects possibly designated for carriage is permitted, subject to the fees, conditions and limitations imposed by EGO Airways and available on the airline's website in the section "Your Baggage".

10.1.3. Passengers shall pay an excess baggage fee for the carriage of Registered Baggage in excess of the Baggage Allowance. EGO Airways will apply a surcharge of EUR 10.00 at the airport for each kg in excess of the Baggage Allowance previously purchased. EGO Airways reserves the right to refuse the carriage of Registered Baggage in excess of the Baggage Allowance for reasons of space and/or security.

10.1.4. The addition of one or more Registered Baggage can be made no later than one hundred and fifty (150) minutes before the scheduled time of departure if such additions are made online or through the call center. If the addition of one or more Registered Baggage is made at the airport, it must be made before the check-in closing time at the authorised ticket offices. The fees applicable to the Registered Baggage may be subject to change if the addition of the Registered Baggage is made at the airport. The Registered Baggage must be delivered to the check-in desk before the check-in closing time . The check-in desk normally opens two (2) hours before departure.

 

10.2. CABIN AND CARRY-ON BAGGAGE

10.2.1. All Passengers may carry on board a Non-Registered Baggage of a maximum weight of 9 kg (maximum dimensions 55 cm x 35 cm x 25 cm), to be placed in the overhead compartments located in the Passenger cabin. Non-Registered Baggage must, in any case, be of size, weight, shape and dimensions that comply with the airline’s standards which can be consulted on EGO Airways’ website on the “Carry-on baggage” page. All passengers may also carry on board a bag or backpack of such dimensions that can be placed under the seat in front of the Passenger. Passengers' rights under this clause may be modified or limited by EGO Airways due to measures adopted by the competent authorities for health or safety reasons, without any liability for the airline.

10.2.2. Non-Registered Baggage that does not comply with the conditions, in terms of size, weight, shape and dimensions, imposed by EGO Airways will be refused at the boarding gate or, where possible, loaded in the hold of the aircraft. EGO Airways shall not be liable for oversize Non-Registered Baggage refused at the boarding gate and subsequently abandoned by the Passenger. The Carrier reserves the right, at its own discretion, to load any Non-Registered Baggage in the hold of the aircraft in case Non-Registered Baggage cannot be loaded into the aircraft cabin for reasons of space and/or safety.

10.2.3. The carriage of liquids, aerosols and gels in the boarding area of an airport and on board the aircraft is governed by the current safety regulations of the European Union.

10.2.4. Items deemed unsuitable for carriage in the hold of the aircraft may still be accepted in the cabin if transported safely and appropriately on a dedicated purchased seat.

10.2.5. Electronic cigarettes may be carried on board but their use or the use of any other type of cigarettes on board the aircraft is strictly prohibited.

10.2.6. Carriage of "smart" bags (bags that contain lithium batteries that allow the Passenger to track and weigh their bag and charge devices via a USB port) is permitted as Non-Registered Baggage, provided that the batteries are removed before placing them in the overhead compartments. The batteries must remain in the possession of the Passenger at all times.

 

10.3. PROHIBITED ITEMS AND REGISTERED BAGGAGE

10.3.1. The carriage of the items listed in article 10.8 below is prohibited.

10.3.2. It is not allowed to carry in the Registered Baggage money, jewelry, precious metals, keys, cameras, personal electronic devices (PEDs) such as laptops, mobile phones, tablets, electronic cigarettes, watches, lithium batteries, medicines, eyeglasses, spectacles, sunglasses, contact lenses, negotiable documents, securities, cigarettes, tobacco or tobacco products or other valuables, business documents, passports and other identification documents or samples.

10.3.3. In exceptional circumstances, in the event that a large personal electronic device is powered by lithium batteries and cannot be carried in the cabin (for example due to its size), and must therefore be carried in the hold, Passengers must provide the following guarantees:

• the device is completely switched off and effectively protected from being accidentally turned on;

• the device will never be turned on during carriage;

• any application, alarm or setting that may activate the device is disabled or deactivated;

• the device is protected from accidental damage by suitable packaging or casing, or by being placed in a rigid bag protected by adequate cushioning (for example clothing);

• the device will not be carried in the same Baggage as any flammable material (e.g. perfumes, aerosols, etc.).

10.3.4. The carriage in the hold of "smart" bags (bags containing lithium batteries to allow the Passenger to track and weigh their bag and charge devices via a USB port) is permitted , provided that the lithium batteries are removed before the Registered Baggage is handed over to the ground staff at the check-in desk or boarding gate. The batteries must be carried on board and remain in the possession of the Passenger.

10.3.5. Upon delivery of the Registered Baggage, the latter will be taken into custody and the Passenger will be issued with a Baggage Identification Tag for each Registered Baggage.

10.3.6. The Passenger's name or other personal identification must be displayed on the Registered Baggage.

10.3.7. Whenever possible, Registered Baggage will be carried on the same aircraft as the Passenger, unless EGO Airways decides to carry it on an alternative flight for security, safety or operational reasons. If the Registered Baggage is carried on a later flight, EGO Airways will arrange its delivery to the Passenger, unless the presence of the Passenger is required to complete customs procedures.

10.3.8. The following items must be carried in the cargo hold: any sharp instrument capable of causing injury, including tennis rackets, baseball and softball bats, golf clubs and sticks (rigid or flexible) such as batons, blackjack (baton with covered flexible shaft leather), cricket bats, hockey and hurley sticks, lacrosse sticks, kayak and canoe paddles, skateboards, pool and snooker cues, fishing rods, martial arts equipment such as knuckledusters, bats, clubs, nunchucks, kubaton, kubasaunt, pointed / sharp weapons and sharp objects; sharp objects or with blades capable of causing injury, including axes and hatchets, cleavers, arrows and darts, grappling irons (iron spikes used in mountaineering), harpoons and spears, ice axes and ice picks, ice skates, knives with blade of more than 6 cm, including lockable or flick knives, ceremonial or religious knives and hunting knives made of metal or any other material strong enough to be used as a weapon, meat cleaver, machetes, open razors and blades (except safety and disposable razors with enclosed blades held in plastic compartments), sabers, swords, chisels, scissors with blades more than 6 cm as measured from the hinge, ski poles and walking / hiking poles, throwing stars, handicrafts with blade or shaft of more than 6 cm which can be used as a sharp weapon or edged weapon such as drills and drill bits, box cutters, box cutters, all kinds of saws, screwdrivers, chisels, crowbars, hammers, pliers, wrenches and torches.

10.3.9. Any sharp object in the Registered Baggage must be securely wrapped to prevent injury to screening and sorting personnel.

 

10.4. COLLECTION AND DELIVERY OF REGISTERED BAGGAGE

10.4.1. In accordance with article 10.3.5 above, it is mandatory to collect the Registered Baggage as soon as it is available on arrival. It is recommended to collect the Baggage at the airport facilities within a reasonable time; failing that, the Passenger may be subject to the payment of a deposit fee, as established by the rules of the airport. The Registered Baggage that is not claimed within three (3) months from the moment it became available for collection may be stored in accordance with article 1515 of the Italian Civil Code without any liability towards the owner.

10.4.2. Only the Passenger holding a Baggage Identification Tag is entitled to receive the Registered Baggage. The acceptance of the Registered Baggage by the Ticket holder without any written complaint at the time of delivery constitutes proof that the Registered Baggage has been returned in good condition in accordance with the contract of carriage.

10.4.3. In the event that the person claiming the Registered Baggage is unable to produce the Baggage Identification Tag or to identify the Registered Baggage, EGO Airways will deliver the Registered Baggage only on condition that such person is able to prove his or her right to the receipt of the Registered Baggage and, in any case, EGO Airways reserves the right to deliver the Registered Baggage on condition that a specific release certificate is issued, which will hold harmless EGO Airways against any other claims, including those of third parties.

 

10.5. ANIMALS AND HUMAN ASHES

10.5.1. The Passenger has the right to carry pets only on condition that they are adequately placed in the appropriate containers, suitable for air transport, indicated by EGO Airways or the Carrier. For more information on the carriage of animals, see the “Pet Friends” page.

10.5.2. For flights operated by EGO Airways, the pet, together with its container and food, if accepted as Baggage, will not be included in the Baggage Allowance but will constitute excess Baggage, for which the Passenger must pay the applicable fare. For flights operated by other Carrier, the Passenger must consult and comply with the conditions applied by that Carrier.

10.5.3. It is the Passenger's responsibility, before the flight, (i) to inquire about any conditions and/or limitations to the transport and/or entry of pets with reference to the country of destination of their trip, (ii) to inquire about any characteristics and/or health conditions of the pet that are incompatible with the flight and (iii) to obtain all health and administrative documentation necessary for the transport and/or entry of the pet. These documents must be valid at the time of departure and for the entire duration of the flight. The Passenger must also comply with all the provisions of the countries of transit, departure or arrival, as well as with the regulations and instructions of EGO Airways. The airline shall not be liable for any sanctions, losses or costs or any further consequences resulting from the failure to comply with the above mentioned conditions and/or limitations and from the failure to possess the necessary documents and/or from failure to comply with the applicable rules and provisions.

10.5.4. On flights operated by EGO Airways, guide dogs for disabled persons will be carried free of charge, according to the terms and conditions available on EGO Airways’ website under the "Pets" page. For flights operated by other Carrier, the Passenger must consult and comply with the conditions applied by that Carrier.

10.5.5. The acceptance by the Carrier of animals for carriage does not imply any obligation on the Carrier to guarantee their entry and/or transit in a country, state or territory, given that the Carrier is unable to review the decisions taken in this regard by the competent local authorities.

10.5.6. The carriage of human ashes is allowed in the cabin, in addition to the Passenger’s Non-Registered Baggage, provided that the Passenger has a copy of the death and cremation certificate. The Passenger must ensure that the ashes are securely packaged in a suitable container with a screw top lid and protected from accidental breakage.

 

10.6. RIGHT TO REFUSE CARRIAGE

10.6.1. The carriage of prohibited items as well as other similar items will be denied if identified.

10.6.2. The carriage of Baggage which is not, at the reasonable discretion of EGO Airways, securely packed in suitable containers, will be denied.

10.6.3. EGO Airways may refuse to accept the carriage of Baggage, or refuse to continue the carriage if already accepted, if it contains any item that is unsuitable for carriage on the aircraft due to its size, shape, weight, content, particular characteristics, fragility, perishable nature or for safety or operational reasons, or because it is likely to cause inconvenience or disturbance to other Passengers.

 

10.7. RIGHT OF SEARCH

10.7.1. For safety reasons and to protect the physical safety of other Passengers and crew members, the Passenger may be asked to consent to a personal inspection and scan, as well as an inspection or X-ray scan of his/her Baggage. If the Passenger is not available, the Baggage will be inspected in his/her absence for the main purpose of determining whether it contains any of the items listed in article 10.8 below.

10.7.2.In the event that the Passenger does not give his/her consent, the carriage of the Passenger and the Baggage may be denied. EGO Airways will not be liable for damages caused by inspection or scanning of the Passenger, as well as for damage caused by X-ray or scanning of the Baggage, unless such damage is due to gross negligence of EGO Airways.

 

10.8. PROHIBITED ITEMS

10.8.1. Passengers are not allowed to carry the following items in the security restricted areas of the airport, in the Registered Baggage or in the Non-Registered Baggage (the list is not exhaustive):

• Explosives, flammable substances and devices capable of, or appearing to be capable of  causing serious injury or posing a threat to the safety of the aircraft, including ammunition, blasting detonators, detonators and fuses, replica or imitations of explosive devices, mines, grenades of all kinds and other explosive military stockpiles, fireworks and other pyrotechnic devices, smoke cans and cartridges, dynamite, gunpowder and plastic explosives, gas and gas containers such as propane and butane, flammable liquids, including gasoline, methanol, flammable solids and reactive substances, including magnesium, fire baits, fireworks, burners, smoke cans and cartridges, other pyrotechnic devices, with aerosol spray paints, turpentine and thinner, alcoholic beverages with alcohol more than 70% by volume (140% proof), organic oxidants and peroxides, including bleaches and body repair kits, toxic or infectious substances, including rat poison, infected blood, radioactive material, such as medicinal or commercial isotopes, corrosive substances, including mercury, vehicle batteries, vehicle fuel system components that contained fuel, edible oil (e.g. olive oil) more than 1 liter by volume, lithium-ion battery-powered vehicles (including segways and hoverboards) other than wheelchairs and mobility equipment, devices powered with lithium-ion batteries with power over 160 watts/hour, which must be removed by the Passenger. Smart bags that do not allow the removal of lithium batteries are prohibited for safety reasons and their transportation will not be permitted on EGO Airways flights.

• Guns, firearms and weapons: any object capable of, or appearing to be capable of, discharging a bullet or causing injury, including all firearms (pistols, revolvers, rifles, machine guns, etc.), replicas and imitation firearms, component parts of firearms (excluding telescopic sighting devices), pistols and air rifles, and pellet pistols. Flare guns, starter guns, toy guns of all kinds, compressed air and CO2, paintball guns, pellet guns, shotguns, ball bearing guns, industrial bolt and band guns, crossbows, bows, slingshots, catapults, harpoons and harpoon guns, devices for killing animals and humans, stun or shock-causing devices, such as stun guns, tasers, stun sticks, spurs, ballistic energy-conducting (laser) weapons, form of firearms.

• Chemical and toxic substances: any chemical or toxic substance that poses a risk to the health of passengers and crew or to the safety of the aircraft or structures, including acids and alkalis, for example "wet" batteries that leak corrosive substances o whiteners such as mercury, chlorine, disabling or incapacitating chemicals, gases and sprays such as tear gas, pepper spray, capsicum, acid sprays, animal repellent sprays, radioactive material such as medicinal or commercial isotopes, poisons, dangerous or infectious biological material such as infected blood, bacteria and viruses, material capable of causing spontaneous ignition or combustion, fire extinguishers (except if authorized by fire protection protocols and as emergency devices for aircraft).

• Paints, Christmas crackers, energy-saving light bulbs, objects with internal combustion engines such as chainsaws, model airplanes and lawnmowers.

• Objects that can endanger the aircraft, passengers or on-board structures.

• Items whose carriage is prohibited by applicable laws, regulations or orders of the state of the city of departure or that of the city of arrival.

• Items that EGO Airways reasonably considers unsuitable for carriage because they are dangerous or unsafe because of their weight, size, shape or characteristics, or are fragile or perishable, taking into account, among other things, the type of aircraft used.

• Fish and birds kept as hunting trophies.

• EGO Airways declines any responsibility for any loss or damage to any item referred to in this article which, despite the prohibition, is contained in the Registered Baggage or Non-Registered Baggage.

 

11. FLIGHT SCHEDULES, CANCELLATIONS, DELAYS & DIVERSIONS

11.1. FLIGHT SCHEDULES

11.1.1. EGO Airways will do its best to carry the Passenger and his/her Baggage with reasonable speediness and, if possible, in compliance with the timetables published on the date of travel, without prejudice to the causes of exemption of liability provided for by current legislation.

11.1.2. The flight timing indicated in the Ticket or elsewhere may change between the time of the booking date and the travel date. When EGO Airways accepts bookings, it informs the Passengers of the scheduled flight timings at the time of booking and which are indicated in the Ticket. However, it is possible that it may be necessary to change the scheduled flight timings after the booking has been made. If the Passenger provides a valid e-mail address and telephone number, the Passenger will be informed of any changes through these means. If the Passenger has made the booking through an intermediary, EGO Airways will communicate any changes in scheduled flight timings to the address provided by the intermediary at the time of booking; any obligation of EGO Airways to notify the Passenger shall be deemed fulfilled with the communication to the address provided by the intermediary.

 

11.2. CANCELLATIONS, DELAYS, DENIED BOARDING AND CLASS DOWNGRADING

11.2.1. In the event of delay, cancellation, denied boarding (so-called overbooking) or lower class accommodation (so-called downgrading), EGO Airways will apply the international, community and national regulations in force, in particular Regulation (EC) no. 261/2004 of the European Parliament and of the Council of 11 February 2004. These rules do not constitute an integral part of the air carriage contract and may be subject to change over time. If, in application of these rules, the Passenger is entitled to reimbursement of the price paid for the Ticket, EGO Airways will refund the fare paid in addition to any taxes, surcharges or fees associated with it and paid by the Passenger. The refund amount does not include any penalties already paid for having made, by way of example, changes in name, date or itinerary, as well as any ancillary costs for the booking service communicated to the Passenger at the time of booking.

 

11.3. DIVERSIONS

11.3.1. If, for reasons beyond the control of EGO Airways, an aircraft cannot land at the destination airport and is diverted to a different airport, then unless the aircraft continues to its original destination airport after the diversion, the carriage by air must be considered to be completed when the aircraft lands at the different airport. However, EGO Airways will arrange alternative transport, with its own or other means of transport, to ensure arrival at the original destination set out in the Ticket, without any additional costs.

 

12. REFUNDS

12.1. NON-REFUNDABILITY

12.1.1. Unless otherwise provided in these General Terms and Conditions of Carriage and as indicated during the booking process, all amounts paid by Passengers for the purchase of an EGO Airways flight (including the amount paid for additional services) are non-refundable.

 

12.2. DEATH OF A FAMILY MEMBER NOT BOOKED ON THE FLIGHT<

12.2.1. In the event of the loss of a close relative (spouse, cohabitant, mother, father, brother, sister, son, grandfather or grandson), occurring before the flight departure date, EGO Airways, upon specific request of the Passenger accompanied by the relevant death certificate, to be made as soon as reasonably possible and in any case before the scheduled departure date, will issue a voucher equal to the amount of the price paid for the unused Ticket, or, at the Passenger's request, to modify the reservation without additional costs.

 

13. BEHAVIOR ON BOARD THE AIRCRAFT

13.1. GENERAL PROVISIONS

13.1.1. In accordance with the Italian Navigation Code and in compliance with other national and international provisions applicable to air transport, the captain is in command of the aircraft and is authorized to take all necessary measures for the safety of the flight. All persons on board the aircraft, whether passengers or crew members, are required to comply with the instructions of the captain. The captain is also authorized to take all those measures deemed necessary in relation to Passengers whose behavior, physical and/or mental state, are considered dangerous for the safety of the flight. The Passenger is responsible for all damages caused by his/her behavior to the airline, its employees and/or third parties.

13.1.2. If, at EGO Airways’ reasonable opinion, the Passenger’s behavior on board the aircraft causes danger to the safety of the aircraft or to any persons or property on board, or prevents the crew from  performing their duties properly, or fails to comply with the crew's instructions, including (but not limited to) those relating to the prohibition of smoking, drinking alcohol or taking drugs, or behave in a way which EGO Airways reasonably believe may anger, upset, offend, intimidate, frighten or injure any Passenger or crew, EGO Airways will be entitled to take any measures it deems reasonably necessary to prevent the continuation of such behavior, including restraining the Passenger. The Passenger may be removed from the aircraft, denied boarding on subsequent flights at any time, and may be reported to the competent authorities for offences committed on board the aircraft.

 

13.2. PORTABLE ELECTRONIC DEVICES

13.2.1. Passengers are allowed to use small portable electronic devices (weighing less than 1 kg) at any time during a flight if “Flight mode” is switched on. For safety reasons, laptops and larger portable electronic devices must be turned off during take-off and landing or at any other time requested by the captain of the flight.

13.2.2. Any device that transmits or receives communications in a mode other than "Flight mode" must be switched off for the whole duration of the flight.

13.2.3. Hearing aids and pacemakers can be used during the flight.

 

14. TRAVEL DOCUMENTS

14.1. In order to travel, the Passenger must have all the entry and expatriation documents, the visas necessary for the trip, the health and vaccination certificates, as well as the documentation certifying that they meet the requirements for any special fares purchased. These documents must be valid at the time of the flight and for the entire duration of the flight. It is the Passenger's sole responsibility to obtain all necessary travel documents. The Passenger must also comply with all the provisions of the countries of transit, departure or arrival, as well as the instructions of EGO Airways.

14.2. EGO Airways will not be liable in any way for the consequences that the Passenger may suffer as a result of its negligence in obtaining such documents or visas or in complying with such laws, regulations, ordinances, requirements, rules or instructions.

14.3. It is the Passenger's responsibility, prior to the flight, to provide EGO Airways with all information regarding any specific limitations and/or conditions with reference to the country of destination of their trip and to obtain information by consulting the Consulates or Embassies of transit and/or destination.

14.4. The Passenger gives its consent to EGO Airways to make a copy of the aforementioned documents for the purposes of compliance with the national, international and foreign legislation on immigration. In this regard, EGO Airways ensures that the data contained therein will be processed in compliance with the privacy protection legislation.

 

14.5. REFUSING ENTRY

14.5.1. Without prejudice to the Carrier's gross negligence, if the Passenger is denied entry to any country due to inadmissibility relating to non-compliance with applicable immigration rules, the Passenger will be required to pay any fine imposed on EGO Airways by the Government or by the competent authorities, in addition to the cost of transport from that country to the point of origin or to any other destination. EGO Airways will not refund any unused flights as a result of denied entry.

 

14.6. PASSENGER LIABILITY FOR PENALTIES AND OTHER COSTS<

14.6.1. Without prejudice to the Carrier's gross negligence, if EGO Airways is required to pay the amount of a fine or other cost as a result of the Passenger's failure to comply with the laws, regulations, orders, or other travel requirements of the country of departure, destination or transit, the Passenger will be required to reimburse, at the request of the Carrier, any amount paid or expenses incurred.

 

14.7. CUSTOMS INSPECTIONS

14.7.1. If necessary, the Passenger must be present when his/her Baggage is inspected by customs authorities or other government or airport authorities. EGO Airways will not be liable to the Passenger for any loss or damage caused during such inspections or as a result of the Passenger’s failure to abide by this condition.

 

14.8. SECURITY CHECKS

14.8.1. Passengers must undergo security checks carried out by duly authorised personnel of the government, airport or airline authorities.

 

14.9. FRAUD

14.9.1. Payments must be authorized by the cardholder named in the booking. EGO Airways reserves the right to cancel any booking without prior notice if there is a good reason to suspect that the Passenger or the cardholder is involved in any fraudulent activity. Such suspicion may be based on the following reasons:

• when requested, the Passenger is unable to show the card used to make the reservation at the airport;

• the Passenger is unable to provide, upon request, the cardholder’s contact information, in order to allow EGO Airways to carry out the necessary security checks;

• the cardholder did not authorise the payment and claims that the booking was completed fraudulently;

• the Passenger, or the cardholder, has previously been involved in any fraudulent activities or has made claims for reimbursement for transactions made;

• the information provided at the time of booking is incorrect/inadequate/inconsistent or connected to fraudulent behaviour;

• there have been several attempts to pay by entering inconsistent data.

 

15. LIABILITY FOR DAMAGE

15.1. International travel, as defined in the Convention, is subject to the liability rules provided for by the Convention and Council Regulation (EC) No. 2027/97 (subsequently amended by Regulation (EC) No. 889/2002). EGO Airways' liability is further governed by these General Terms and Conditions of Carriage.

15.2. EGO Airways' liability for death or other physical injury suffered by the Passenger shall not be subject to financial limits. EGO Airways is subject to strict liability up to the amount of 128,821 SDRs. EGO Airways is not liable for damages exceeding 128,821 SDRs if it proves that the damage was not due to the negligence, wrongful act or omission of EGO Airways or its employees or agents or that the damage was solely due to the negligence, wrongful act or omission of a third party.

15.3. The Carrier, if required by its national legislation, shall without delay, and in any event no later than fifteen (15) days after the identity of the natural person entitled to compensation has been established, make the advance payment as may be required to meet immediate economic needs on a basis proportional to the hardship suffered. In the event of death, the advance payment shall not be less than 16,000 SDRs per Passenger. An advance payment shall not constitute recognition of liability and may be offset against any subsequent agreement. Advance payments shall not be returnable unless:

• EGO Airways proves that the damage was caused by the fault of the injured or deceased Passenger, or that this behavior contributed to causing the damage;

• if it is subsequently proved that the person who received the advance payment was not the person entitled to compensation;

• if it is subsequently proved that the person who received the advance payment caused or contributed to causing the damage by negligence.

15.4. Except as provided in the previous articles 15.2 and 15.3, the liability of EGO Airways is governed as follows:

• any liability of the airline will be reduced on a basis proportional to the Passenger's concurrence of fault which caused or contributed to causing the damage, in accordance with applicable law;

• EGO Airways will not be liable for any damage suffered by Non-Registered Baggage, except where the damage is caused by the airline's fault;

• EGO Airways will not be liable for any damages resulting from the application of laws and regulations, or from the non-compliance by Passengers.

15.5. In the event of the destruction, loss, damage or delay in carriage of the Registered Baggage, EGO Airways' liability is limited to 1,288 SDRs (or equivalent) per Passenger, unless the Passenger has made, at the time when the Registered Baggage was handed over to the Carrier, a special declaration of interest and has paid an additional fee. EGO Airways may refuse to accept the special declaration of interest of the Registered Baggage, in the event that part of the carriage is performed by another Carrier that does not offer a similar option.

15.6. If these General Terms and Conditions of Carriage provide for a particular provision, EGO Airways shall be liable to Passengers only for compensable damages, losses and demonstrable costs, in accordance with the Convention.

15.7. EGO Airways shall not be liable for any damage caused by the Passenger's Baggage. Each Passenger will be liable for any damage caused by their Baggage to any other person or property, including property owned by EGO Airways.

15.8. EGO Airways shall be liable for damages incurred in the event of the destruction, loss or damage of the Registered Baggage provided that the event which caused the destruction, loss or damage occurred on board the aircraft or during the time period in which the Registered Baggage remained in charge of the airline. However, EGO Airways will not be liable if and to the extent that such damage is due to an inherent defect, quality or vice of the Registered Baggage. EGO Airways will also not be liable for any damage to prohibited items contained in the Registered Baggage, in accordance with the previous article 10.8, as they are considered unsuitable for carriage because they are dangerous or unsafe, or because of their weight, size, shape or nature, or because of their fragility or perishable nature, taking into account, among other things, the type of aircraft used. With reference to Non-Registered Baggage, including personal items, EGO Airways will only be liable if the damage is caused by the fault of the airline, or by  ault of its employees or agents. Please refer to Article 10 for the list of objects that cannot be carried in the cabin and/or in the aircraft’s hold.

15.9. EGO Airways will not be responsible for any illnesses, injuries or disabilities, including death, attributable to the psychological conditions of the Passenger or the aggravation of the same.

15.10. These General Terms and Conditions of Carriage, the exclusions or limits of liability contained therein apply to employees, staff and representatives of EGO Airways to the same extent as they apply to the airline. The amounts recoverable from the airline shall not in any case exceed the amount of EGO Airways’ liability, if any.

15.11. Nothing in these General Terms and Conditions of Carriage shall waive any exclusion or limitation of the airline’s liability under the Convention or applicable laws, unless otherwise expressly stated.

15.12. Pursuant to Article 19 of the Convention, if the Passenger or its Registered Baggage suffer a delay in the carriage by air, EGO Airways shall not be liable for damage occasioned by a delay if it proves that the airline and its servants and agents took all measures that could reasonably be required to avoid such damage or that it was impossible for the airline or them to take such measures. Should EGO Airways be liable for damage caused by delay, except for cases of willful misconduct or gross negligence, liability for such damage is limited as follows:

• for damage caused by delay in the carriage of Passengers, liability is limited to 5,346 SDRs for each Passenger;

• for damage caused by delay in the carriage of Registered Baggage, liability is limited to 1,288 SDRs for each Passenger.

 

16. CLAIMS PROCEDURES

16.1. NOTICE OF CLAIMS

16.1.1. For the purposes of any claims related to Registered Baggage pursuant to article 16.1.2, the collection by the holder of the Baggage Identification Tag, without complaint at the time of delivery of the Registered Baggage, constitutes evidence that the Registered Baggage was delivered in a good condition and in compliance with the contract of carriage.

16.1.2. In the event of damage to the Registered Baggage, the Passenger entitled to delivery must, as soon as the damage is ascertained, submit a written complaint to EGO Airways. In case of damage to the Registered Baggage, the Passenger must complete and transmit the complaint within seven (7) days from receiving the Baggage and, in case of delay, the complaint must be submitted within twenty-one (21) days from the date on which the Registered Baggage was placed at the Passenger’s disposal.

16.2. ALTERNATIVE DISPUTE RESOLUTION

16.2.1. EGO Airways informs Passengers that a European platform has been established for the online resolution of consumer disputes relating to goods and services purchased online in the European Union (so-called ODR platform). The ODR platform can be consulted at the following address http://ec.europa.eu/consumers/odr/. Through the ODR platform, Passengers will be able to consult the list of ADR (Alternative Dispute Resolution) bodies, find the link to the website of each of them and initiate an online dispute resolution procedure. To this end, EGO Airways' email address is ODR@egoairways.com.

16.3. TIME LIMITS FOR CLAIMS

16.3.1. Any right to damages under the Convention must be initiated within two years of the date of arrival at destination or the date scheduled for arrival at destination of the aircraft or the day on which transport ended. The time limit is determined in accordance with the law of the court where the case is heard.

16.3.2. The time limit for claiming compensation pursuant to Regulation (EC) no. 261/2004 is determined in accordance with the law of the court where the case is heard.

 

17. POINT TO POINT CARRIAGE

17.1. EGO Airways only operates point to point flights, i.e. flights connecting two different airports. EGO Airways offers connecting flights only for single connections (e.g., from point A to point C, with a connecting flight at B). These flights are referred to as connecting flights within the booking. Therefore, EGO Airways does not offer, nor it facilitates the transfer of Passengers or their Baggage to other flights, whether operated by EGO Airways or other Carriers, unless Passengers have booked a connecting flight.

 

18. FORMS OF PAYMENT

18.1. Due to the high security and administration costs, EGO Airways cannot accept cash payments for tickets, taxes, or costs associated with the carriage of excess Baggage and sport equipment. Some airports may have local agreements for accepting cash and are often able to accept major debit cards issued in their respective countries. Passengers wishing to use these forms of payment at the airport to pay for these services should contact the airport in advance to check if the airport accepts cash and/or debit cards.<

18.2. Passengers who pay for their flights in a currency other than the currency of the flight departure country will be charged in the currency of the issuing country of the payment instrument used, as well as a currency commission. Passengers can check the actual amount to be paid before making the payment.

 

19. PERSONAL DATA

19.1. EGO Airways, as data controller, collects, processes and uses the Passenger's personal data for the purpose of carrying out the air transport service and any ancillary services. EGO Airways processes personal data in accordance with the provisions of EU Reg. 2016/679 (hereinafter "GDPR") and the Legislative Decree of June 30, 2003 No. 196. EGO Airways, pursuant to article 37 of the GDPR, has appointed a Personal Data Protection Officer (EGO Airways Data Controller, Viale Giulio Richard, 1 - 20143 Milan, e-mail: privacy@egoairways.com).

19.2. EGO Airways guarantees that the processing of personal data, however acquired, is carried out in compliance with fundamental rights and freedoms, as well as the dignity of the data subject, with particular reference to confidentiality, personal identity and the right to the protection of personal data.

19.3. These data are collected, processed and used, mainly through automated systems, exclusively for the aforementioned purposes and may be shared by EGO Airways with its authorized agents, as external "managers" of the processing pursuant to art. 29 of the GDPR, as well as, in the case of code share agreements with other Carriers, with the latter as independent data controllers. Furthermore, EGO Airways may transmit the Passenger's personal data to the competent authorities and/or government agencies, both national and foreign, if they request it in accordance with the applicable rules and the transmission is therefore necessary for the execution of the airplane transport’s service.

19.4. For the purposes of carrying out the air transport service and any ancillary services, "sensitive data" may also be processed pursuant to the GDPR. These data may be processed in cases where the Passenger has requested, for example, specific medical assistance from EGO Airways and/or an airport operator, or has otherwise chosen to provide such information (for example through the travel agent who made the booking).

19.5. By providing personal information that is or could be considered "sensitive data", the Passenger authorises EGO Airways to collect, process, use, share with third parties and transfer, including outside the European Economic Area (EEA), such personal information.

19.6. In relation to health emergencies, pursuant to sector regulations, EGO Airways may be required to request and process certain personal data in order to combat and contain the spread of epidemics or similar phenomena. The data collected and processed in this context will not be disclosed to third parties but may be disclosed to the competent health and public security authorities. The data controller of such data will be EGO Airways S.p.A., with registered office in Piazzale Libia 2, 20135 Milan, which will keep the data collected for a period of time not exceeding what is necessary to achieve the purposes for which they are collected and treated.

19.7. In the event that the Passenger does not authorise or withdraw its consent to the processing of data, EGO Airways may not be able to provide, in whole or in part, the services requested by the Passenger.

19.8. Pursuant to Regulation (EU) no. 996/2010, the Passenger, at the time of booking or during the Ticket purchase process, has the right to communicate to EGO Airways the name, telephone number and e-mail address of a third person who can be contacted in the event of a plane crash. These data will be processed exclusively for the aforementioned purposes and will not be disclosed to third parties or used for commercial purposes.

19.9. EGO Airways’ customers, in order to assert their rights under the GDPR, can contact the data controller of personal data by sending a communication to the registered office at Piazzale Libia 2, 20135 Milan, or to the Data Controller by sending a communication to EGO Airways, in Viale Giulio Richard, 1 - 20143 Milan, or by sending an e-mail to privacy@egoairways.com.
